General
Article 1. Definitions
1.1. Policy holder: the person named on the insurance policy.
1.2. Insured: all members of the travelling party, comprising: policy holder, his/her spouse, household member(s), their children and other travelling companions, provided that they are named on the insurance policy.
1.3. Phanos Resorts: Phanos Resorts B.V.
1.4. Family: persons who are registered at the same address on the population register and live as part of a family.
1.5. Household member(s): those person(s) who are entered at the same address in the population register.
1.6. Insurance policy: Reservation confirmation Phanos Resorts.
1.7. Due sum: the total of the sum due in advance and/or paid sums for bookings and accommodation reservations.
1.8. Cancellation: the necessary cancellation or premature termination of an arrangement on reasonable grounds, comprising the accommodation, as a result of an unforeseen incident outside the control of the insured.
1.9. Cancellation costs: (partial) due sum and transfer costs due, in the event of a cancellation.
1.10. Holidays not taken: a consecutive period of 24 hours, which falls in the period of a reserved holiday.
1.11. Relatives once or twice removed: once removed: spouse/life partner, parents (in-law), children and children by marriage, twice removed: brothers (in-law), sisters (in-law), grandparents and grandchildren.
Article 2. The insurance is effective:
2.1. For reservations at Phanos Resorts resort.
2.2. As of the commencement date of the insurance up to and including the end date of the trip.
2.3. Double Insurance: if, in the event this insurance did not exist, a claim for compensation could be made under any other insurance policy, whether or not from an earlier date, or on the basis of an Act or other provision, this insurance shall only apply in the final instance. In that case, the claim for damages shall be restricted to the sum that exceeds the sum for which the insured could submit a valid claim elsewhere.
Article 3. Obligations
In the event of damage or loss, the insured must - at the risk of losing all rights:
3.1. Inform the landlord of his intention to cancel as soon as possible, yet within 3 working days of the event.
3.2. Restrict the scope of the loss as much as possible.
3.3. Complete and send a claim form within 14 days of cancellation or arriving home.
3.4. Send the following documents:
a The reservation confirmation.
b. The cancellation costs invoice.
c. Proof of booking or reservation note.
d. Proof in respect of the scope of the loss and the cause.
3.5. To reply completely, correctly and honestly to all requests for information by or on behalf of Phanos Resorts.
3.6. Follow all instructions issued by or on behalf of Phanos Resorts.
Insured reasons for cancellation
Article 4. Insurance cover is provided for cancellations as a consequence of:
4.1. Serious accident, serious illness or the death of:
a. The insured.
b. His once or twice removed relatives by bloodline or marriage and members of his household, insofar as this relates to a real and immediate life-threatening situation.
c. Any other person (third party), provided that they are named on the confirmation.
4.2. a. An intended stay that cannot take place with family or friends at home or abroad as a result of an unexpected serious illness, serious accident or death, which means the insured cannot be accommodated.
b. Damage to the reserved accommodation, which renders the accommodation unsuitable for use.
4.3. Pregnancies confirmed after concluding the insurance, which can be confirmed by a pregnancy statement and/or complications during pregnancy.
4.4. Material damage to property, domestic or company buildings of the insured of such a nature that warrants the presence of the insured at the location in the capacity of owner, tenant or actual leader, - also if he is called back.
4.5. An event caused by other factors, such as a collision, theft and fire within 30 days of the departure date, as a result of which the personal
means of transport cannot be used, and cannot be repaired within the given timeframe.
4.6. a. Involuntary unemployment, through no fault of the insured, provided that the dismissal date is less than 1 month after the end of the booked holiday.
b. Obtaining gainful employment for a minimum of 20 hours a week for a period of at least one year or an indefinite period within 10 weeks of departure or during the holiday, insofar that the date of employment lies within the stated period: following
a period of unemployment during which unemployment benefits were received.
4.7. a. Unforeseen allocation of rented accommodation, within 30 days of the start of the holiday. Condition is that the insured can provide an official rental contract from which this is evident.
b. Purchase of a house, provided that the completion date/transfer takes place within 60 days of the start of or during the holiday.
4.8. Definitive irretrievable breakdown of the marriage, for which divorce proceedings have been started after booking the arrangement. Dissolution of a cohabitation agreement signed in the presence of a lawyer is considered equivalent to this.
4.9. An unexpected exam retake, which cannot be postponed until after the booked holiday, after taking final exams for a multi-year educational course.
4.10. An unanticipated failure to obtain a visa, unless the failure by the insured to obtain a visa was a result of the late application for a visa by the insured or his representative.
4.11. Cancellation by a travel companion who also has valid cancellation
insurance and who is subjected to an event that is covered by his insurance conditions, leaving the insured as sole travelling party. Condition is that the insured and the travel companion who is insured elsewhere would travel to and from their destination
together and that the cancellation insurance of the travel companion who is insured elsewhere does not provide cover for any compensation to the insured. In this context, the term the insured is also understood to mean a family.
4.12. A necessary medical procedure which the insured, his partner or a child from the same household has to undergo.
Article 5. Compensation includes:
5.1. a. The cancellation costs that are due following cancellation.
b. The pro-rata calculated loss in the event of premature termination
of the arrangement.
c. The pro-rata calculated loss in the event of an unforeseen hospital
admission (a minimum of one overnight admission) of the insured for the hospitalised insured and his relatives once and twice removed travelling with him and named on the policy.
d. The costs of transferring to a later date, which prevents full cancellation.
Article 6. Entitlement to payment
If one of the insured parties described in article 1.2 cancels before departure on account of a reason for which cover is provided, then persons who are part of the same family may also cancel. In the event of relatives who do not live as part of the family, the maximum compensation has been set at 4 insured parties, or 4 insured families. In the event of cancellation or premature termination of the organised holiday, compensation shall be paid proportional to the insured persons in a family, and also for 1 extra family, unless provided for otherwise by virtue of clause 02.
Claims Payment
Article 7. Claims payment
7.1. Phanos Resorts shall proceed to paying compensation to the policyholder after the obligation to pay and the sum of the compensation payment have been established by Phanos Resorts. Payment must be made by transfer into a bank or giro account stated by the insured.
7.2. The policy holder declares to agree with the established compensation, if he does not lodge a written appeal against this within 14 days of notification of payment.
Exclusions
Article 8. No cover is provided for losses:
8.1. As a result of nuclear atomic reactions, war or an equivalent situation.
8.2. As a consequence of armed conflicts to overthrow the existing authorities.
8.3. Arising from loss of income.
8.4. Taking into account all pre-existing illnesses, disorders or abnormalities of the insured, the members of his household or relatives once or twice removed. This exclusion is only applicable if the insurance is concluded more than 7 days after the booking date.
Group cancellation
A. The death of a member of the travel company
The costs of cancelling the arrangement on account of the death of a member of the travel group are also insured, provided that the extra premium has been paid.
B. The death, illness or accident of a member of the travel group.
The costs of cancelling the arrangement on account of the death, serious illness or accident of one of the members of the travel group who are specified on the confirmation or his/her relatives once removed are also included.
C. Illness or accident of a member of the travel group
The costs of cancelling the arrangement on account of a serious illness or accident of one of the members of the travel group are also insured.
